Introduction

I have been working in the Criminal Justice system for the last 30 years and the courts and the public speaking are no unfamiliar to me.
In fact I have learned that good presentation and speaking skills are so important, without them, your personal and business success cannot get into the top 5 per cent of your industry. And this is where you need to be!

“ No one who aspires to success in any profession can neglect the art of communication. The role of the communicator has become dominant in the careers of anyone who must try to convince others” Jack Valenti – Presidential speech writer.

Our profession is clearly overcrowded; there are no more lawyers on this planet than there are soldiers. If you think average is enough, please stop reading.
I left the police force many years ago. I realized that one I entered the world of law I had to lift my game. It was no longer giving evidence in the witness box, and giving it my best shot, but to run my own highly successful legal practice, and to get outstanding outcomes for my clients, I needed to become an excellent and first class professional at speaking.
I have read most books on this planet on public speaking, I have seen the best speakers on the planet speak, I joined Toastmasters International many years ago, and achieved the competent communication recognition, and I also joined Rotary International.
I enrolled and completed about 20 media speech and presentation courses over the years, and have worked as a legal affairs commentator pro bono on National news and current affairs, and National morning shows over the last 15 years.
I have also hosted my own own award winning Television show on public TV all over Australia over the last ten years.
Besides this I am in Court almost every day, helping people get the best outcomes possible. And I do get them the best outcomes.
Why did I do all this? Because I know that the hallmark of a good advocate is that he or she avoids legal speak, and instead knows how to talk to any group or industry or person in a simple, relaxed and confident manner.
I don’t mean to be rude, but I knew that the boring lawyer with personalities like dead indoor plants who always spoke in flat monotone, unbroken by even an occasional pause or suggestion of light and shade in their voice, were always putting people to sleep, and tended to remain in the bottom 20 per cent of their profession. These are the facts. Speaking skills are important?
Pretty speeches change the world. Nothing is more truthful than that, because it’s difficult to determine what was moral, what was talent, what was fervor, and what was just plain silly when it comes to public speaking and the herd behavior that follows a pretty speech.
When people love a speech, they don’t just applaud—applauding is the least of what they are doing. Their heart transforms. Their mind lets down its defenses. They become followers of the speaker. They abandon their former reasoning and embrace the emotion of the moment.
And when people are caught up in emotion they take action. Sometimes that action leads to positive things, like a victorious circle of friends running around town holding up the kid who saved the day and bringing cheer and smiles to everyone around them.
Then of course there is the inevitable, Hitler, Stalin and Mussolini scenario. Brilliant orators who inspired people to madness. Indeed, a good public speech is more than communication, or at least, it’s communication beyond the normality of human relationships. It is transcending the human experience and preaching, prophesying and foretelling great and wondrous things.
When you give a good speech you are a king or queen among men. The adrenaline rushes and you at once feel the excitement resonating from the people around you—people you have inspired. It’s a great powerful human experience, the likes of which is almost impossible to describe; something life-changing and awe-inspiring.
Then of course, you get up there, look at all those empty, tired faces and…you…freeze.
“Uhhh…”
“Ummm…”
And then the stuttering begins. Then your mouth goes dry. Your heart palpitates. The panic sets in. Suddenly, you’re not giving a “speech”, you are marching into battle, into certain death—death by embarrassment!
And who can deny that public speaking is a scary experience if you seldom do it? It is actually considered one of the worst human fears, comparable to death for some people who dread the idea of looking out and seeing only judgment.
Of course, as lawyers, you and I have been accustomed to public speaking; perhaps in court, perhaps in one-on-one negotiation or discussion. It is a part of what we do. To be afraid and to whimper at a challenge is simply not an option. We speak because we have to. This is human interaction that is required and fear is certainly not a becoming quality.
Now, all that said, just because you can speak publicly does NOT make you a superstar lawyer. I mean think about the less than perfect orators of our time that were always publicly speaking but never actually putting any fire into their words:

· Al Gore
· Tiger Woods
· Asif Ali Zardari
· Prince Charles (Prince Charles actually consulted with actress Gillian Anderson recently, for advice on public speaking…yes Gillian, the tight-lipped beauty from the monotone dialog of The X-Files )

At the opposite of the spectrum, you have performers who are so over the top when they speak, they are actually quite ridiculous and almost funny to watch, because they butcher a good speech with a little bit too much incineration!
