Prologue
The air was warm and the sky was gleaming, there wasn’t a cloud in the sky. The wind was just right as the man of war ship HM.S. Charles D. was sailing the Northern Atlantic making her way to Portsmouth Harbor. Her Captain and crew were busy at work minding the sails and rigging as she sailed gracefully through the water. Her sail master, John Penn was at the helm. He was quite sure that the ship will make it to the mainland in a few days.
Prowling the seas, the Charles D. sliced through the water at full sail ahead; her Captain Henry Emerson was down in his quarters filling in his logs. There was pounding on his cabin door and before he could say anything the individual barged in. As the door swung opened he heard from within was chaos. He quickly stood from his desk to accompany his officer when a lead ball pierced the officer’s lower left portion of his shoulder striking him in the heart, blood splattered everywhere and he hit the deck hard killing him instantly.
It seemed like the corruption was coming up towards the quarter deck of the ship. He quickly gathered his cutlass and flint lock pistol and proceeded cautiously out his cabin door. Scouting around to make sure he wasn’t going to be the next victim of a lead ball he hesitated out the door knowing that one of his officers are not lying dead by his cabin door he reached for his weapons for extras then headed towards the poop deck to see what the shooting and chaos was about.
He noticed all the commotion was coming from the quarter deck where John Penn and the rest of the crew were now joining him. Lead balls were flying in every which direction, which now he knew explained the death of one of his officers. He fired off a shot of his own and that’s when the crew came to a screeching halt. Looking up towards the poop deck where the captain stood, the crew seemed to calm down a bit. There were a few clanging of swords and cutlasses and an occasional firing of flint locks here and there.
Captain Henry Emerson had a cold look on his face, he demanded what the commotion was all about. He slowly approached his crew down on the quarterdeck, most of them put their weapons away. One of them said, “don’t worry Captain we’ve got it under control!” and pointed to the sailmaster.
Captain Emerson looked in the direction of one of his crew member’s point of the finger directly towards Penn.
“I ain’t caused nothin’ sir!” Penn protested, he was tied to the main mast blood pooling out of his nose, “Someone took shots and and then we all shot.”
In the far distance of the ship, a man stood with a smirk on his face he was sitting up on one of the mizzen top yards watching the commotion below. He snickered to himself, those fools don’t know nothin’ about piracy, that scallywag good for nothing will hang for what was done and this ship will be mine! Too bad for that bloody officer that I shot down making it look like an accident, a lead ball piercing his heart, such a shame he took his chance, that’s what you get for being a crew of a war ship he thought to himself sarcastically. Still watching from up above, no one noticed that he was up in the mizzen scouting out the whole scene. He hoped the captain would file piracy on the man and then once they make berth, he will hire a few mates to cut the lines and take the Charles D. and develop his own crew and make himself the captain. Good luck fellow sailors, officers, and old crew of this bloody ship, she will be mine in a few days with or without ye all! Fuck the captain and his so called crew! There were a few other members of the cew wounded and bleeding all over the deck, two of members had arms blown off and some had shoulders torn out of place. One was missing half of his leg.
Down on the quarter deck, the captain pondered on what should be done with Mr. Penn for the time being, half of the crew wanted him keel hauled and the rest wanted him locked up in the brig. The captain insisted that they be fair since he was not a witness, he wanted to question him once they reached berth so the brig it was. Some of the crew was unsatisfied with the decision but dealt with it for the time being and continued on with their duties. Captain Emerson assigned his first mate to helmsmen for the continuation of their journey back to port. Now for Mr. John Penn, thrown in to the ships brig, was beaten and flogged by the crew sat there looking out a small peep hole that as caused by a lead ball shot was his only mean of watching the sea and where the ship was heading, it was a slow and torturous voyage back to Portsmouth Harbor knowing that his life is at stake.
Still looking through the peep hole, the ship was moving at a steady pace, in a few days she will make berth and that’s when things become limited for him. They will put him through trial he will face the judge, plead not guilty in which will buy him time to think of a way to slow down the process, he did not want to face the gallows for something that he knew he did not commit, he had friends in high places back in town but he wasn’t sure if they could help him much, but it was worth a shot. He believe that somewhere out there in the Atlantic a very well-known captain she be due to make berth with her ship might be his ticket out of the gallows. This captain will save his life along with another well-known captain of the Atlantic in whom he is great friends will do his best to set him free as well. There was only one great attorney in town in which one of the two captains is a blood relative who will stop at nothing to set him free. Behold he must pull himself together and figure out what he should do since now his life is at stake and possible slowly coming to an end.
As they reached the mainland, Captain Emerson and one of his officer went down to the brig to fetch John and bring him up on deck. Captain Emerson gave order for two of his best officers to escort Mr. Penn straight to the towns jail and to immediately write up statements on what happened on board the Charles D. Stepping on to the pier, John Penn and the three officers started towards the road that led to the town jail. John’s arms were tied behind his back and the three officers had weapons pointing at his back. they wanted justice and they wanted it now.
Entering the domain of the towns jail, John and the three officer’s of the navy entered a large heavy door that led to a few flights of stairs that formed a narrow dark and damp hallway to roughly about five to ten cells. The officers just picked one cell that was not occupied, opened the cell door and harshly pushed and shoved John in to it and quickly slammed the door behind him and locked it.
John turned around quickly to get a better view of the officers that escorted him there and noticed one had a smirk on his face. The other two had no expressions on theirs. Frustrated John spoke up to them, “I did not do anything of the like… I am being accused for piracy in which I did not commit… somebody else did this not me! You have to listen to me, please… I am loyal to you officers and quite frankly you can ask the remaining crew… I did not do this!”
“Say that to the prosecutor and write it on your death bed or even on you stone!” replied one of the officers, “we don’t care, we saw we know… and well good luck, the captain will see you soon. You can tell him your thoughts and concerns when he arrived.”
John just stood there hands gripping the cell bars white knuckled from being so furious. He knew that he did not commit such piracy he was just doing his duty sailing as ordered due north then come about and head towards the harbor. He knew something was suspicious with one of the officers that took him in here. Something about him was just not right. That spirk, he hated that smirk. Almost like he knew who did it and was not going to acknowledge the fact that he knew who the person was. John knew that if he could find out who the prosecutor was in town maybe he would have a better chance of getting a better trial and will give him time to think, think about who that officer was with that smirk… he began to grip the bars even tighter as he thought about the officer then pushed away from the bars and sat on the cold stone floor of the cell room. He then thought about his sister. He wondered if she might know a few people out there that might be ab
