One of the g reat co n tr o versies concerning ri g hts is whether or not t hey are unalien a ble . Unalienab l e rights are those r ights that can never be alienable, i.e., sold or tran s f erred. So if you or I had a rig h t to— life, l i berty, and t he pursuit o f happiness, f or example, t h ose rights c ould never be taken away. It is as if they co m e as a part o f our exi s ten c e. When we use the t erm “God-given rights,” we mean un a lienable. In The Declaration of Independenc e , 1776, the term Creator i s used: We hold thes e truths to be se l f -evident , that all me n are created equal, tha t they ar e endowed by thei r Creato r with certain unalienabl e R i g h ts , that amon g thes e ar e Life, Liber t y, and the pu r suit o f H a ppiness. That to sec u r e thes e rights, Go v ernments ar e instituted am on g M en, derivin g thei r just powers fro m th e consent o f the governed. T hat whene v er any F or m o f Government become s destructive o f thes e ends, it is th e R i ght o f the Peopl e to alte r o r t o abolish it . . . Now, whatever Creator m e ans to you, it's implication here is that it is absolute, of the primary order or given of things from which unalienable rights can then f o llow a s unalienabl e . The point here is to stipulate rig h ts that are o utside of m an's sancti o n. We don't get to d eci d e what rights a re a ny more t h an we g e t t o decide t h e laws of na ture. W e can discover them, but they already are as in p rimary (a p riori) or eternal. An unali e n able right is not s omething man (men a nd women) can ta k e a way because it i s prim a ry to our li v e s. So unalienable rights are not something that m a n or the state creates—and the r efo r e man or t h e sta t e cannot take them away. We have t h em intrinsi c ally as per ou r exis t e
