The Commission welcomes and encourages the comments of accredited institutions and interested parties
and wishes to emphasize that thoughtful comments are important and that the Commission will give
careful consideration to those comments received. With regard to the proposed revisions to the Standards
of Accreditation, the Commission encourages you to read carefully the proposed revisions and to submit
comments and recommendations for consideration by the Commission. After considering the written
comments, the Commission may adopt the revisions as proposed, adopt the revisions with additional
changes, defer action for further study and consideration, or reject the proposed revisions. If the
Commission adopts these revisions, ACCSC will establish an effective date allowing reasonable time for
institutions to come into compliance.

Written comments are due by January 15, 2010 and sent to the attention of Michale S. McComis, Ed.D.,

Schools to Be Considered List for the February 2010 Meeting Available Online

The Commission has prepared and published a list of the schools that may be considered at its February
2010 Commission meeting. Reviews scheduled for the February 2010 meeting include, but are not limited
to, those schools that have undergone evaluations for initial and renewal applications for accreditation;
substantive changes such as the addition of new programs (i.e., non-degree, degree and distance
education), changes of location, changes of ownership, and the addition of separate facilities; and other
reviews as may have been deemed necessary by the Commission.

The Commission’s Schools to be Considered List can be found on its website at www.accsc.org. Go to
“Commission Actions” and then “Schools to be Considered.”

Accredited institutions, governmental and non-governmental agencies, industry members, the general
public, and other interested parties are invited to submit written comments pertaining to any school
included on the Commission’s list. Comments should include information that will assist the Commission
in making a decision regarding the accreditation action pending for a school. Any comments received will
be forwarded to the school with an opportunity to submit a response to those comments. The deadline to
submit written comments is January 12, 2010. Submit written, signed, and dated comments to Nickia

Proposed Revisions to Section VIII, Rules of Process and Procedures, Standards of Accreditation –
Appeal of Commission Decisions

The Commission has reviewed the new provisions within the Higher Education Opportunity Act of 2008
and the ensuing regulations that go into effect July 1, 2010 that change the requirements for accrediting
agencies regarding due process. The Commission proposes to change its current Rules of Process and
Procedure to align with these new regulations and requirements.

The new federal regulations for the recognition of accrediting agencies that will go into effect July 1,
2010 can be found in the Federal Register, Vol. 74, Tuesday October 27, 2009, Rules and Regulations, p.
55429, §602.25 Due process, which can be accessed by clicking here.

The Commission’s current Rules of Process and Procedure do not provide an allowance for new financial
information to be submitted during the appeal process, do not set forth a requirement for a teach-out plan,
and do not address the specific range of actions available to the appeals panel as required by the new
federal regulations. The Commission has addressed the new federal requirements in the proposed
revisions set forth below. The Commission has also taken this opportunity to review this section of the
ACCSC Rules of Process and Procedure in its entirety as a means to ensure that all of the Commission’s
policies and procedures are captured and to ensure consistency and clarity in the language.

Accordingly, the Commission recommends the following revisions to Section VIII, Rules of Process and
Procedure, Standards of Accreditation (new language in bold and italic print deleted language indicated

VIII. APPEAL OF COMMISSION DECISIONS
A. Coverage of Appeals
The appeal procedure specified in these Rules is the exclusive remedy for a school that believes that
an adverse accreditation decision by the Commission is unwarranted pursuant to the terms set forth
in this section.
1. Only adverse accreditation decisions made by the Commission are subject to appeal may be
appealed. Adverse accreditation decisions are:
a. Denial of a substantive change application under Section IV, Rules of Process and Procedure,
Standards of Accreditation;
b. Denial of an application for accreditation (initial or renewal); and
c. Withdrawal of Revocation of accreditation.
2. An accredited school remains accredited, operating under a Probation Order, until the final
disposition of the appeal. The Commission will follow its public notification requirements in
accordance with the provisions set forth in these Rules.
3. The Commission will not consider petitions for reinstatement or petitions for reconsideration.

B. Grounds for Appeal and Standard of Review
1. A school affected by an adverse accreditation action taken by the Commission may appeal that
decision if it has reason to believe the Commission’s decision was arbitrary, capricious, or
otherwise in substantial disregard of the criteria or procedures of the Commission, or not
supported by substantial evidence in the record on which the Commission took action.
2. In order for a school subject to an adverse accreditation decision to revoke accreditation to be
eligible to submit its Grounds for Appeal, a school must submit a teach-out plan as directed by
the Commission and as required by Section IV (E)(7), Rules of Process and Procedure and
Section I (G), Substantive Standards, Standards of Accreditation.
23. On appeal, the school has the burden of proof.
34. The Appeals Panel will only consider that information that was before the Commission at the
time that the adverse action was taken.
45. The record on an appeal will include, as applicable, the Letter of Intent to Appeal, Grounds for
Appeal, Team Summary Report(s), Commission action letter(s), school response(s), and other
documents relevant to the appeal.
56. The appeal fee and all other fees due to the Commission must be paid in full in order to have
standing to appeal a Commission decision.

C. Appeal Procedures
1. Letter of Intent to Appeal: To initiate an appeal process the school must submit a Letter of Intent
to Appeal accompanied by the required appeal fee, within 10 days after receiving official notice
of the adverse accreditation decision.
2. Grounds for Appeal: Within 30 days of receipt of the Commission’s notice of adverse
accreditation decision, the school must submit 10 copies of the Application for Appeal of a
Commission Decisions and Grounds for Appeal.
