Tous les États membres de l'Union Européenne prétendent que l'obtention d'un logement est une priorité. Cependant, cette prétention est-elle un droit constitutionneilement reconnu ? En s'appuyant sur le texte fondamental de chaque État membre, l'étude met en lumière la problématique du droit constitutionnel ainsi que la jurisprudence des cours constitutionnelles relatives au droit au logement. Cette communication conduit à examiner l'affirmation constitutionnelle du droit au logement, d'une part, et sa portée juridique, d'autre part. La première partie met ainsi l'accent sur la difficile reconnaissance constitutionnelle du droit au logement. La deuxième partie s'articule autour de deux axes : la protection et l'applicabilité du droit au logement. L'étude conclut que le soin de concevoir ce droit revient au législateur en raison des imprécisions constitutionnelles. Elle montre enfin, l'existence d'une hiérarchie tant dans l'affirmation normative du droit au logement que dans sa portée.
All European Union member states daim that the right to lodging is a priority. Nevertheless, is this daim recognized as a constitutional right ? Examining the constitutional text of each member state brings out the constitutional problematic as well as the constitutional Courts decisions about this right. The study implies the analysis of the constitutional affirmation of this right on one hand, and its legal significance on the other hand. The first part highlights the difficulties of a constitutional recognition of the right to lodging. The second part is based on two main lines : the protection and the applicability of the right to lodging. This study concludes that the implementation of that right is the legislator's responsibility because of constitutional vagueness. It shows finally, the existence of a hierarchy, not only for the standards affirmation of the right to lodging, but also for its significance.
