Le droit s’efforce de lutter contre les odeurs qui incommodent la société. Il était dès lors intéressant de se demander s’il offrait des mécanismes de réservation privative adaptés pour protéger celles qui stimulent l’économie. Pour ce faire, il convenait de confronter au droit de la propriété intellectuelle les deux composantes de la création olfactive que sont, d’une part, la source odorante et d’autre part, le message olfactif. Du travail de recherche entrepris, il résulte que la source odorante, qu’elle soit appréhendée de manière totale ou partielle, ne peut intégrer le champ d’application du droit de la propriété industrielle. Sa protection est dès lors assurée par d’autres mécanismes de réservation, tels que le droit de la responsabilité civile ou le droit pénal. Quant au message olfactif, il ne parvient pas non plus à accéder au statut d’objet de propriété incorporelle. Il n’est accueilli, ni par le droit d’auteur, ni par le droit des marques. Pourtant, ces droits sont en mesure de lui offrir protection. La confrontation du droit de la propriété intellectuelle à la création olfactive révèle donc les limites de ce droit. Tandis qu’il est inadapté à la source odorante, il est inappliqué au message olfactif. Tout pousse néanmoins en faveur d’une amélioration de notre droit positif

Law endeavours to protect society against offensive odours. We should then wonder whether it offers adequate means of private protection so as to protect those which are a stimulant to the economy. Thus, we attempted to confront to the intellectual property law both components of the olfactory creation, these being, on the one hand, the chemical formula and on the other hand, the olfactory message. The result of our research work is that the chemical formula, whether it is considered in a total or in a partial way, cannot be integrated into the scope of the industrial property law. It follows that its protection is ensured by other protection mechanisms such as public liability or criminal law. As far as the olfactory message is concerned, it can neither manage to reach the status of incorporeal property object. It is neither included in copyright nor in trademark law. Yet, these rights are in a position to offer it protection. The confrontation of the intellectual property law to the olfactory creation reveals, then, the limits of this law. Whereas it is not adapted to the chemical formula, it is not applied to the olfactory message. Nevertheless, everything tends in favour of an improvement of our substantive law
